According to a new report by CBS, Montalvo was 29 years old, and as of Tuesday morning was still in critical condition following the gun shot and surgery thereafter.
The report also notes that Stephen Wahl, the deputy who shot Montalvo, was not injured during the incident, and has been, in accordance with PD policy, assigned to non-law enforcement duties for one week.
Montalvo’s Facebook page indicates he submitted a Tough Enough tape back when casting for the show was taking place, but of course was not cast on the show. The spokesperson for the Orange County Sheriff’s department said Montalvo had previously been the subject of a Baker Act court order, in which a patient can be involuntarily detained for mental health treatment.
